Is it illegal for the media (local news) to post my children pics Ages 12 and 7? without parental consent?

My children were involved in an indecent assault by a man in our local walmart! they caught the act itself on their surveillance cameras. Obviously walmart turned the video over to the state police and in an effort to catch this asshole they released the video to the media so they would post pics of this guy on the news! well as my husband and were watching the news played the entire surveillance tape! including my childrens faces, the act itself, and even my children running scared to find help! ( we were an aisle away) I was devastated that they showed their faces and the news stations had no consent from us to do so? Is that illegal?

Possibly…it is certainly irresponsible as the children are minors.
If I were you I would seek legal advice.

Depends where you live I suppose but I do think it should be if it is not, make a complaint seek legal advice. They should have blurred them out or had your permission.

It is a gray area. Since it was on surveillance at a store and the store gave it to the news station and they didn’t name your kids– it could be viewed more as public record and they are ok.

However, if the children are singled out and its obvious who they are and information about them (name, age, etc.) is posted with it– then you definitely have an issue.

If it really bothers you, I would find someone in the law profession to run this by.

This is rather unusual, usually the victims faces are blurred out , I think you should perhaps consult a lawyer and contact both the police organization as well the tv outlet.

In Canada media release forms must be signed, although since this is a police matter that may be waived. You should have been contacted first though. Go to your lawyer and see what he/she has to say.

You don’t really have any rights to privacy if you’re in a place that the general public saw or could have seen what happened. The TV guys usually do blur out innocent, especially young, people. But, if you’re in public, it’s hard to lay a claim to privacy.
